Terms of Service

1. Scope

These Terms of Service apply to all services of Butcher Shop Müller, in particular to the online shop and the ordering of products.

2. Orders

Orders can be placed online via our shop or by phone at +41 56 222 69 04. We reserve the right to refuse or cancel orders.

3. Prices and Payment Terms

All prices are stated in Swiss francs and include value added tax. Payment is due upon collection of the goods.

4. Collection Terms

Collection takes place during the stated opening hours. Home delivery is not available.

5. Warranty

Our products meet high quality standards. Complaints must be reported within 24 hours of collection.

6. Source Code License & Usage Rights

The source code of the digital solution (website, management system, online shop) is provided to the customer after full payment for exclusive personal use only. The source code may be downloaded and used for the customer's own business.

Expressly prohibited:

  • Passing on, selling, or licensing the source code to third parties
  • Using the source code (in whole or in part) to create products, websites, or solutions for other clients, companies, or individuals
  • Reproduction, decompilation, or reverse engineering for the purpose of redistribution
  • Removing, deactivating, or circumventing the integrated security tool

7. Integrated Security Tool

A security and monitoring tool is integrated into the source code, ensuring compliance with the terms of use. This tool monitors the usage of the source code and ensures it is used exclusively for the contractually agreed purpose (personal use by the buyer).

By downloading the source code, the customer or the person downloading it expressly agrees to the following conditions:

  • Acknowledgment of the personal use license as per Section 6
  • Consent to the integration and operation of the security tool
  • Acceptance of monitoring to ensure license-compliant usage

8. Legal Consequences of Misuse

In case of violations of the terms of use (Sections 6 and 7), Abgemacht.ch reserves the following measures:

  • Immediate blocking: deactivation of all digital services and the source code without prior notice
  • Contractual penalty: CHF 50,000 per violation, immediately due upon detection
  • Damages: claim for actual damages incurred if exceeding the contractual penalty
  • Civil action: civil proceedings for injunction, removal, and damages under Swiss law
  • Criminal complaint: filing of criminal charges for copyright infringement and unfair competition
  • Cost assumption: all legal and procedural costs are borne entirely by the offending party

Jurisdiction: The competent court at the registered office of Abgemacht.ch. Swiss law applies exclusively.
